This web page represents our Terms of Use and Sale (“Agreement”) regarding our website, located at Handicapdocs.com, and the tools we provide you (the “Website” or the “Service”). It was last posted on November 1, 2022. The terms, “we” and “our” as used in this Agreement refer to TermsFeed.

We may amend this Agreement at any time by posting the amended terms on our Website. We may or may not post notices on the homepage of our Website when such changes occur.

If you do not wish to be so bound, please do not use or access our Website.  Furthermore, by using the website and furnishing your PHI, and when you sign, agree and pay for our services, you are attesting and swearing to us that you have provided us with accurate and truthful information regarding your medical conditions or limitations.  You are not permitted to furnish us with medical information which is not accurate for the purpose of obtaining a disabled parking permit.  This statement particularly refers to your limitations and ability to walk 200 feet without stopping to rest.  You are aware that if you are not limited or impaired in your ability to walk 200 feet without stopping to rest, you may not qualify for a disabled parking permit.  Furthermore, decisions regarding permanent disabled parking permits versus temporary disabled parking permits are 100% the discretion of the doctor who performs the consultation.  Just because you desire a permanent 4 year disabled parking permit does not mean the doctor will prescribe the permanent disabled parking permit.  This is a medical decision and you agree that you will get only the appropriate disabled parking permit which will be decided by the doctor.

Limited License

Handicapdocs grants you a non-exclusive, non-transferable, revocable license to access and use our Website in order for you to pay for the service of a state licensed doctor obtaining your medical records and reviewing them for the purpose of determining the need for a handicap parking permit through our Website, strictly in accordance with our Legal Terms.

Copyrights and Trademarks

Unless otherwise noted, all materials including without limitation, logos, brand names, images, designs, photographs, video clips and written and other materials that appear as part of our Website are copyrights, trademarks, service marks, trade dress and/or other intellectual property whether registered or unregistered (“Intellectual Property”) owned, controlled or licensed by Handicapdocs. Our Website as a whole is protected by copyright and trade dress. Nothing on our Website should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on our Website, without the prior written permission of the Intellectual Property owner. Handicapdocs aggressively enforces its intellectual property rights to the fullest extent of the law. The names and logos of Handicapdocs, may not be used in any way, including in advertising or publicity pertaining to distribution of materials on our Website, without prior, written permission from Handicapdocs. Handicapdocs prohibits the use of any logo of Handicapdocs or any of its affiliates as part of a link to or from any Website unless Handicapdocs approves such link in advance and in writing. Fair use of Handicapdocs’ Intellectual Property requires proper acknowledgment. Other product and company names mentioned in our Website may be the Intellectual Property of their respective owners.

Our Website may contain links to Websites owned or operated by parties other than Handicapdocs. Such links are provided for your reference only. Handicapdocs does not monitor or control outside Websites and is not responsible for their content. Contracts and Legal Advice Disclaimer

You understand that we offer handicap parking permit approvals determined by licensed doctors as a service through our website.  You acknowledge that we will ask for and will need pertinent medical documentation including but not limited to diagnostic test results such as CT scans, MRI, Xrays, ultrasounds, and/or medical notes, exam findings, diagnoses, in order to make a determination of the necessity for a handicap parking permit.  You understand and acknowledge that we will need, in order to verify your identity, a copy of your driver’s license or government issued ID to process this service.  You understand and acknowledge that we make no guarantees that you will be approved for a handicap parking permit.  You understand and acknowledge that the approval of your handicap parking permit is based on specific criteria outlined by the state law which you live.  You understand and acknowledge that Handicapdocs will charge your card for this service and the service is clearly understood. You understand and acknowledge that if you feel that you do not need this service, you should not use the service or pay for the service.

You understand and acknowledge that the ONLY service that Handicapdocs provides is certifying you for the handicap permit.  This means we provide you with a signed application.  You will need to bring the signed application to the department of motor vehicles and you will be responsible and will need to pay any applicable fees to obtain the actual permit at the DMV or tag agency.

Refunds

We issue refunds if, within 14 days of receiving your approved handicap permit application, you are not given a handicap parking permit by the department of motor vehicles when our signed form is presented to them, AND we cannot resolve it for you by communicating with the DMV or tag agency.  Please contact us by email at info@handicapdocs.com if the DMV or tag agency is not accepting your signed and approved handicap application, and we will intervene and help resolve the problem.

If within 14 days of placing your order for our service, you are unable to obtain medical records, you must contact us by email at info@handicapdocs.com so we can help resolve this issue with one of our affiliated doctors. If within 14 days we cannot assist in obtaining medical records for you or make a determination based on an exam, at your written request by email, we will issue you a refund for the service.

You understand and acknowledge that there are no refunds once we approve your handicap application AND email the signed and approved handicap permit application to you if you simply change your mind.  

If you cannot obtain your handicap parking permit at the DMV after we complete our consultation, approve you, and mail you your signed form, you MUST return the ORGINAL signed application to us, before your refund is processed.  Only AFTER we receive the ORIGINAL document (not copied), will we grant your refund.

 We agree to refund your money if after we review your medical records, we cannot certify you for a disabled handicap parking permit.

**Currently servicing Florida only.  If you make the mistake of purchasing our service and you are NOT a Florida resident, then you will be refunded MINUS any applicable Credit Card Processing fees plus a $10 service charge.

 

 

 

No Warranties; Exclusion of Liability; Indemnification

OUR WEBSITE IS OPERATED BY Handicapdocs ON AN “AS IS,” “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

WITHOUT LIMITING THE FOREGOING, Handicapdocs DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ON THE WEBSITE IS ACCURATE, COMPLETE, RELIABLE, USEFUL, TIMELY OR CURRENT OR THAT OUR WEBSITE WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

You agree to defend, indemnify and hold Handicapdocs harmless from and against any and all claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of our Website or any Contracts or Services you purchase through it.

Confidentiality of your health information

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This notice is required by law to inform you of how Handicapdocs protects the confidentiality of your health care information in our possession. Protected Health Information (PHI) is defined as individually identifiable information regarding a patient’s health care history, mental or physical condition or treatment. Some examples of PHI include your name, address, telephone and/or fax number, electronic mail address, social security number or another identification number, date of birth, date of treatment, treatment records, x-rays, enrollment and claims records. Handicapdocs receives, uses and discloses your PHI to determine if you qualify for a handicap parking permit. Any other disclosure of your PHI without your authorization is prohibited.

We follow the privacy practices described in this notice and federal and state privacy requirements that apply to our administration of your PHI. Handicapdocs reserves the right to change our privacy practice effective for all PHI maintained. We will update this notice if there are material changes and redistribute it to you within 60 days of the change to our practices. We will also promptly post a revised notice on our website. A copy may be requested anytime by contacting the address or phone number at the end of this notice. You will be able to obtain a copy of this notice by visiting our website https://www.Handicapdocs.com. Applicable law requires Handicapdocs, DBA to maintain the privacy of your protected health information and to provide you with notice of our legal duties and privacy practices with respect to protected health information.

YOUR RESPONSIBILITY:  By using the HandicapDocs website and furnishing your Protected Health Information (PHI), and when you sign, agree and pay for our services, you are attesting and swearing to us that you have provided us with accurate and truthful information regarding your medical conditions or limitations.  You are not permitted to furnish us with medical information which is not accurate for the purpose of obtaining a disabled parking permit.  This statement particularly refers to your limitations and ability to walk 200 feet without stopping to rest.

 

Permitted uses and disclosures of your PHI so we can determine if you qualify for a handicap parking permit.

Your authorization of these practices is essential for us to provide our services. We need you to provide accurate information so that we can conduct a preliminary screening to determine whether to connect you with one of the doctors we work with, who will assess whether to make a written recommendation for a handicap parking permit. You can opt-out and decide not to provide the requested personal information. However, by doing so, we will be unable to conduct our screening and provide you with this service. You can also request that we not use any information you submitted by clicking here.

The only personal information we collect is your name, email address, responses to the questions that are required to properly fill out the handicap parking permit application. We also collect a copy of your driver’s license and medical documentation and we collect payment information. 

We use the information we collect to determine whether you qualify for a handicap parking permit. By checking the box, you are giving us your written authorization to permit us to use your personal health information this way. Any other uses and disclosures not described in this notice will be made only with your written authorization, which you may subsequently revoke. We also use personal information to obtain payment from you.

 

You have the right to request an inspection of and obtain a copy of your PHI.

You may access your PHI by contacting Handicapdocs at the address at the bottom of this notice. You must include (1) your name, address, telephone number, drivers license number, and (2) the PHI you are requesting. Handicapdocs may charge a reasonable fee for providing you copies of your PHI. Handicapdocs will only maintain that PHI that we obtain or utilize in providing your parking permit determination.

You may not inspect or copy PHI compiled in reasonable anticipation of, or use in, a civil, criminal, or administrative action or proceeding, or PHI that is otherwise not subject to disclosure under federal or state law. In some circumstances, you may have a right to have this decision reviewed. 

 

You have the right to request a restriction of your PHI. 

You have the right to ask that we limit how we use and disclose your PHI, however, you may not restrict our legal or permitted uses and disclosures of PHI. While we will consider your request, we are not legally required to accept those requests that we cannot reasonably implement or comply with during an emergency. If we accept your request, we will put our understanding of writing. 

 

You have the right to correct or update your PHI.

You may request to make an amendment of PHI we maintain about you. In certain cases, we may deny your request for an amendment. If we deny your request for amendment, you have the right to file a statement of disagreement with us and we may prepare a rebuttal to your statement and will provide you with a copy of any such rebuttal. If your PHI was sent to us by another, we may refer you to that person to amend your PHI.

You have the right to request or receive confidential communications from us by alternative means or at a different address. 

Alternate or confidential communication is available if disclosure of your PHI to the address on file could endanger you. You may be required to provide us with a statement of possible danger, as well as specify a different address or another method of contact. Please make this request in writing to the address noted at the end of this notice.

You have the right to receive an accounting of certain disclosures we have made, if any, of your PHI.

You have a right to an accounting of disclosures with some restrictions. This right does not apply to disclosures for purposes of treatment, payment, or health care operations or for information we disclosed after we received a valid authorization from you. Additionally, we do not need to account for disclosures made to you, to family members or friends involved in your care, or for notification purposes. We do not need to account for disclosures made for national security reasons, certain law enforcement purposes or disclosures made as part of a limited data set. You have the right to be notified following a breach of unsecured protected health information. 

Handicapdocs will notify you in writing, at the address on file, if we discover we compromised the privacy of your PHI.

 

Other Privacy Disclosures.

We may occasionally use your name and email address to send you updates, advertisements, or promotions.
When you pay for anything on our site using a credit or debit card, we use the personal information needed to complete the transaction. This information includes your name, account number, and other information necessary to process your payment, all of which is clearly labeled on the form you use to submit payment.
However, we do not have access, nor do we store or keep your credit, debit, or bank account information. We use an unaffiliated payment processing company to process your payment. We transfer your payment information—and you authorize us to do so—to this company solely for this purpose. The company does not retain, share, store, or use personally identifiable information for any other purposes.

We automatically collect certain information from visitors to the site, such as Internet addresses, browser type, Internet Service Provider (ISP), referring and exit page, operating system, timestamps, and clickstream data. We also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers. Our website uses Google Analytics to collect information about how our site is used. This information includes how often someone visits our site, the pages viewed, and prior sites visited. We will consider determining if someone under the age of 18 requires a handicap parking permit if the person applies with a parent or legal guardian.

Before we are able to provide you with any information, correct any inaccuracies, or delete any information, however, we may ask you to verify your identity.
